CNN's Gloria Borger, CNN Senior Legal Analyst Jeffery Toobin and Jay Sekulow Chief Counsel, American Center for Law & Justice discuss comments the president made about the Supreme Court and discuss the meaning of "judicial activism".
And, although the Supreme Court is an unelected (but not "uninelected") body, the Justices are also appointed for life for a reason (by a President who has a term of 4 years). This way they cannot succumb to current trends and political opinion. The Founders thought of this when they wrote the Constitution. We have a system of checks and balances. The Supreme Court determines the supreme law of the land. Apparently, the President was trying to intimidate the Court–perhaps even threaten it. He was also undoubtedly trying to win favor of the public and bring down the 70 percent approval rating of the Court, which is the only branch of government that currently has a favorable rating.
Judicial activism means they are not strictly construing the Constitution; they are broadening it. If this ever happened, it was during the 1960s in Earl Warren's Court.
Regarding Marine Sergeant Gary Stein , who criticized President Barack Obama on Facebook and called him a "domestic enemy" in a posting to an internal military network. Marine Sergeant Gary Stein, is just as racist as the tea party. He believes the absurd lies from the extreme racist right wing that suggests that Obama is to blame for what the Bush era of bank and financial institution deregulation and irresponsibility, leading to banks and wall street fraud and subsequently near economic depression. Where was the tea party to stop the Bush administration and Bush era Republicans from tanking the economy to a near world depression? They only surfaced under the pretext of economic concerns with undue blame on Obama...It's an obvious racist veil... Wake up America!! Obama is the "Ernie Davis" of politics...He has been subjected to the same racist attacks that Ernie Davis suffered and especially in the big game against one of the more racist environments...
From before Obama took office, the extreme racist right literaly went on record and vowed to make sure Obama did not succeed. They did not take this kind of action against Clinton or any other white politician...
Obama took necessary steps to shore up the next Bush era great depression from happening while the extreme racist right obstructed every effort to rebuild the economy. Inspite of the extreme racist right's relentless obstructionism, Obama has been able slowly rebuild the economy. Imagine how much stronger the economy would be if the extreme racist right did what is best for the country and not for their twisted extreme racist idealism? It's all because Obama is a person of color in the highest office of our country and he's cleaning up their mess. The idea that a minority is cleaning up a non-minorities mess just kills them...
Even the media is blind to these truths...The extreme racist right is now trying to blame Obama for polarizing the U.S. That's like blaming Obama for the Bush administration and Bush era Republicans' tanking the economy into a near world depression...Sure, blame the "minorities"...it's what racist do better...just like the Nazi's did, right?
You want to know why the real estate market is not rebounding like people want? It's because property values were pushed and artificially inflated during the Bush era...and they just looked the other way...Where was the tea party then? Lenders worked with appraisers to push values...Where was the tea party then? The real estate bubble was growing and the financial markets were warned...Where was the tea party then? Again, they only showed up because a "minority" President was elected to clean up their mess.
Judicial activism occurs only when the Court oversteps its bounds by legislating or creating new law.
